Hemp Verses Cannabis What’s the Difference?

Two terms, two definitions, two sets of laws. Confusion over what qualifies what, and the meaning of either rages in communities all over the country. What’s the difference between them, and how do those definitions affect consumers?   

Hemp, the Legal Hero 

Hemp is legally defined in the United States under the 2018 Farm Bill as Cannabis sativa plants that contain no more than 0.3% DELTA-9 THC (tetrahydrocannabinol) by dry weight. This definition distinguishes hemp from cannabis, which, by definition, is flower that contains more than 0.3% DELTA-9 THC. The legal distinction is crucial because hemp is not considered a controlled substance, allowing it to be grown, processed, and sold legally across the country, as long as it is below the DELTA-9 threshold. However, hemp as defined, can contain various cannabinoids such as CBD, CBN, THCa, and more. Cannabis, Conditionally Awesome 

Cannabis, legally speaking, is generally defined as the plant species Cannabis sativa, Cannabis indica, and any other varieties of the cannabis plant that contain more than 0.3% DELTA-9 THC. Federally, cannabis is classified as a controlled substance under the Controlled Substances Act as a Schedule I drug. However, the legal landscape has shifted with state-level legalization, allowing cannabis to be used medicinally or recreationally in certain states. Check local laws for specifics on legality.

When flower is heated, such as when it’s smoked or vaporized, the compound THCa undergoes a process called decarboxylation. This chemical reaction occurs when the heat breaks off a carboxyl group (COOH) from THCa, turning it into THC (tetrahydrocannabinol), the psychoactive compound. As a result, THC is activated and is able to produce the typical effects associated with cannabis use, like the "high" that users experience.
